These questions have no clear answer because our current moment has no precedent. For the first time in history, the Supreme Court is preparing to abolish a fundamental right that has been enshrined in law for nearly a half-century: the ability to terminate a pregnancy before viability without risking legal penalties. Never before has the court established an individual right, safeguarded it for 50 years, then abruptly cast it aside—greenlighting an overnight overhaul of civil and criminal laws in a majority of the states. It may be tempting to believe that, after Roe, the country will revert to the status quo ante: Many states will outlaw abortion, some states will permit it, and others will restrict it to limited circumstances. But the tidal wave of draconian laws across the country proves that this forecast is a fantasy.
If the right to abortion was created by government why can’t it be un-created? This transitory nature of civil rights is why we recognize and protect our Natural rights, those endowed to us by our Creator. And resist rights “created” by governments.
The obligation of the government is to protect the baby’s Natural right to life and the mother’s Natural Right to liberty. By definition, the Natural Right to liberty of the mother cannot include infringing those of the baby. (Just as it could not include the enslaving of another person in Antebellum America.) The responsibility for raising a baby from conception to adulthood belongs solely to his or her parents and, thus, the authority for raising him or her belongs solely to the parents. Liberty is not license. It is the right to exercise one’s authority in meeting one’s responsibilities.
It is very tempting to have governments “create” rights that let us dodge our responsibilities. That is, until the government changes its mind and decides that it is you that should be the one helping someone else dodge his or her responsibilities.
